November 5, 2008 - An investor in American Depository Shares (ADS) of Sadia SA (NYSE: SDA) filed a lawsuit in the U.S. District Court for the Southern District of New York against Sadia SA over alleged violations of Federal Securities Laws in connection with certain allegedly false and misleading statements made between April 30, 2008 and September 26, 2008.

According to the complaint the plaintiff alleges that Sadia SA entered into undisclosed currency derivative contracts to purportedly hedge against the Sadia SA’s U.S. dollar exposure and characterized the amounts of these contracts as “nominal.”, so the lawsuit. But the plaintiff alleges that these contracts violated Sadia SA’s policy in that they were far larger than necessary to hedge normal business operations and resulted in a loss of $365 million and as a result of defendants’ admission of violating Sadia SA’s policy regarding currency hedging the ADSs of Sadia SA closed at $9.50 per share, down from the previous day’s close of $15.27, a decline of 38%.
